1. Acceptance of Terms
By accessing Waypoint, you agree to comply with these terms. If you do not agree, please discontinue use of the service.
2. Description of Service
Waypoint is an independent platform that aggregates and displays gaming data retrieved from Microsoft and Xbox APIs using officially documented and publicly available endpoints. Waypoint is not affiliated with, endorsed by, or sponsored by Microsoft Corporation or Xbox. All trademarks and branding belong to their respective owners.
3. Content Disclaimer
Waypoint displays content sourced from Microsoft and Xbox services, as well as user activity. Key points:
- No liability is assumed for the accuracy, legality, or appropriateness of content retrieved from Microsoft services.
- Content retrieved from Microsoft and Xbox services remains subject to Microsoft's terms of service.
- The presence of any content on Waypoint does not imply endorsement.
- Users engage with all content at their own risk.
4. User Accounts
Authentication is handled through Microsoft account sign-in. You are responsible for maintaining the security of your account and for all activity that occurs under your session.
5. Age Requirement
You must be at least 13 years old to use Waypoint. If you are under 16 in the European Economic Area, you may only use the service with the consent of a parent or legal guardian.
6. User Obligations
Users must:
- Use the service in compliance with all applicable laws.
- Refrain from any unlawful, harmful, or fraudulent activity.
- Not attempt to interfere with or disrupt the service or its infrastructure.
- Provide accurate information when required.
7. Intellectual Property
The design, layout, and original content of Waypoint are protected by copyright. You may not reproduce, distribute, or create derivative works from any part of the service without prior written permission.
8. Privacy
Use of Waypoint is subject to our Privacy Policy, which describes how we collect, use, and protect your data.
9. Subscriptions & Billing
Waypoint offers optional paid subscriptions ("Pro") that provide access to additional features.
Billing:
- Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected).
- Subscriptions bill upfront at the start of each period, not in arrears — each charge pays for the upcoming billing cycle, not one already used.
- Payments are processed securely by Stripe. Waypoint does not store your payment card details.
- By subscribing, you authorize recurring charges at the applicable rate until you cancel.
Free trial:
- A free trial may be offered at our discretion. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and the first invoice for the upcoming billing period will be generated at that moment.
Failed payments & past-due access:
- If a recurring charge is declined by your card issuer, your subscription will be marked as past-due and Pro access is automatically suspended until payment is recovered.
- Stripe will automatically retry failed payments on a smart-retry schedule (up to four attempts spread across the billing period). No action is needed from us; each attempt happens between Stripe and your card issuer.
- Once a retry succeeds, the payment clears the invoice for the billing period that was already running — it does not start a fresh period from the payment date. The next regular charge then occurs at the normal cycle anchor.
- Pro access tracks successful payment, not the calendar. Days during the past-due window are not recoverable. Those days are also not billed — you are not charged for periods where payment did not succeed, so no refund applies either way.
- If your card repeatedly fails, please update it via your account settings or contact your bank. Card declines are between your bank and Stripe; Waypoint cannot resolve them on your behalf.
Cancellation:
- You may cancel your subscription at any time via your account settings.
- Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until that date.
- No partial refunds are issued for unused time within a billing period.
Refunds:
- Subscriptions are generally non-refundable. If you believe you were charged in error, contact us and we will review your case.
- Past-due windows (periods when payment did not succeed) are not refundable and not billable — no charge was issued for those days, and access was not granted.
- This does not affect any statutory rights you may have under applicable consumer protection laws.
Price changes:
- We reserve the right to modify subscription pricing. Existing subscribers will be notified in advance of any price change, which will take effect at the next billing cycle.
Feature availability:
- Pro features are subject to change. We may add, modify, or remove features at any time. A subscription does not guarantee access to any specific feature indefinitely.
- Some features depend on third-party services and APIs that are outside our control. If a third-party service becomes unavailable or is discontinued, related features may be modified or removed without compensation.
10. Downloads
Waypoint allows users to download media captures (screenshots and game clips) from Xbox services. Download limits apply based on your account type:
Free users:
- Up to 5 individual downloads per day.
- Downloads are tracked locally and reset daily.
Pro Standard subscribers:
- Unlimited individual downloads.
Pro Elite subscribers:
- Unlimited individual downloads.
- Access to mass download (bulk archives): up to 2 archives per day, with each archive holding up to 30 captures.
- Archive download links are available in your account for 48 hours after creation.
General download terms:
- Downloaded content remains subject to Microsoft's terms of service and the rights of the original content creators.
- Downloads are provided for personal use only. Redistribution or commercial use of downloaded content is prohibited unless authorized by the content owner.
- Waypoint does not guarantee the permanent availability of any media for download, as content may be removed or restricted by Microsoft at any time.
11. Capture Deletion
Waypoint allows authenticated users to delete their own media captures (screenshots and game clips) from their Xbox account directly through the service. Deletion limits apply based on your account type:
Free users:
- Up to 5 individual deletions per day.
- Deletions are tracked locally and reset daily.
Pro subscribers (with the deletion benefit):
- Unlimited individual deletions.
General deletion terms:
- Deletion is permanent. Once a capture is removed, it cannot be recovered through Waypoint.
- Deletion requests are forwarded to Microsoft services and may take a short time to fully reflect across all surfaces.
- You may only delete captures that belong to your own account. Captures owned by other users cannot be removed through Waypoint.
12. Disclaimer of Warranty
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose or uninterrupted availability.
13. Limitation of Liability
To the fullest extent permitted by law, Waypoint and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.
14. Termination
We reserve the right to suspend or terminate your access to the service at any time, without prior notice, for conduct that we determine violates these terms or is harmful to other users or the service. In the event of termination, active subscriptions will not be refunded unless required by applicable law.
15. Changes to Terms
These terms may be updated from time to time. Because we do not collect your email address, we cannot notify you directly when changes are made. You are responsible for reviewing this page periodically to stay informed of any updates. The "Last Updated" date at the top of this page indicates when the terms were most recently revised.
For changes that materially affect your rights, such as pricing, billing, dispute resolution, or how your data is handled, we will display a notice on the service for a reasonable period before the changes take effect. For all other changes, the "Last Updated" date is your reference point.
Continued use of the service after changes are posted constitutes acceptance of the revised terms. If you do not agree with a change, your remedy is to discontinue use of the service.
16. Governing Law
These terms are governed by the laws applicable in your jurisdiction. Any disputes shall be resolved in the competent courts of the relevant region.
